憲法 v.s 公投大對決！誰的位階比較高？ - 唸謠言給你聽，大給公鶴恩鶴 EP2

您好，這裡是打給工鶴嗯鶴，我是一隻鶴。


如果過去各位朋友有看過任何：「公投」是國民主權最高的展現位階、「公投民意結果高於憲法」，這些都是錯誤的喔！因為大法官釋憲位階比較高。大法官解釋就是憲法解釋，位階效力就等同於憲法，也就是最高等級。
司法院表示，依據公投所通過的 創制立法原則 審議完成的法律，位階還是「法律」，不得牴觸憲法、也不能牴觸 相當於憲法位階的 司法院解釋。因為大法官解釋的位階就跟憲法一樣。

除非你是修憲。

但是我國憲法規定的修憲程序中，修憲需要 國會四分之三多數通過，通過之後 還要經過公民複決，門檻是選舉人數的二分之一、大概九百多萬人。


只有立法院 依憲法規定 提出的複決公投，才可以修改憲法。其他的公投，不能夠修改憲法，當然也就沒有超越憲法的效力。


其他還有一些公投做不到的事情、公投人民不用繳稅、公職如何付薪水、或是國家預算，還有罷免總統與縣市首長也不能用公投決定。


之所以有這個限制是因為，

如果今天主流民意想要叫長得矮的男生結紮，所以發起「你是否同意 身高低於平均兩個標準差的男性需結紮」公投，還真的因為人數優勢而過了，這樣的法律還是會因為牴觸憲法平等權而無效唷。順道一提，根據 2016 年英國研究，台灣男性平均身高為 174 公分。憲法平等權，是不是真的很重要呢？
司法院大法官 釋憲制度，就是在防止民意天元突破、多數民意會影響少數人權益而存在的。

想請問喔，如果是聽完影片內容所做的整理，版權是歸影片方還是自己可以任意使用阿？
著作權的所有人必定是該作品的作者，除非作者放棄。
並不會因為說我做了某某影片的逐字稿，該逐字稿的著作權就自動變成影片所有人的。
至於我是否持有能製作這逐字稿（影片之重製物）的權利，那是另一條規則。
影片作者可以透過公眾授權(CC之類的)的宣告，去開放讓大家重製。
如果原影片沒有公眾授權宣告，那多半就是去討論重製物是否為「合理使用」
喔喔，那大概不能拿來用惹

再對照小孩拿著剪刀和刀已經向人群揮舞，

媽都心碎了，而奶奶呢?一昧地說都是別人的錯!

用錯方法比殺人還可怕，因為你已經在不知不覺中教了一個殺人魔!

往往自己的心魔成的阻礙

很多人都是當了父母，才開始學會當父母，
他們都倚恃著自己是當醫生、律師、工程師、大老闆、老師什麼的，
但往往他們才是一群最喪盡天良的人，

他們都自以為是最聰明的一群人，最有同理心的一群人，
但往往專家只不過是訓練有素的狗，

最大的經融弊案、廠房工安爆炸、跳樓事件、小三小四小七小八、
幫人脫罪、陷害人入獄、狼師、虐師......等，
嘲笑人87或8+9並不會讓你的地位比人更高一點，

雖然脫口秀讓人訕笑，但當有天你也被訕笑，
最好你也笑得出來，但人群中你還真的要笑出來，
因為許多人都病了沒藥醫，拉不下臉，因為包袱越來越大了，
我是當人家爸了、當經理了、當院長了、當董事長了、有錢可以買你們全家了......等!

甚至也有人結婚了，不打算生孩子，只因為害怕這病態的社會，和自己養育了一個殺人魔!

而不知道的卻還一直生，生了也養不起，還虐待…...等!惡的循環就此展開!
狼性的社會，踩著別人往前的人生，只要別人理解你的人生，只要別人聽你話走的人生，
而這樣的現實社會，很快就會在選舉中產生，你會看到一群人前仆後繼地往前，
把別人都批的一無是處，自己卻都漏洞百出的攤在陽光下面，
是那樣的赤裸，背後的金流四溢，看到對自己有利的拼命渲染，說成好像自己想的，

但不過就是從一堆資訊中拼湊出來，這樣的你有比別人好嗎?

別人都這樣做，所以你有比別人差嗎?

有人說把你的專業做好做滿，自然你說話就有力量，
但這是真的嗎?
